Frequently Asked Questions
Understand the fundamentals of Mexican property rights, foreign ownership, and corporate regulations with clarity.
Yes. Ballote & Associates conducts exhaustive title searches through the Public Registry of Property (Registro Público de la Propiedad) and municipal Catastro records. We trace the unbroken chain of ownership, verify that the seller has unrestricted legal capacity to convey title, ensure property taxes (predial) and municipal fees are paid in full, guarantee that no mortgages, liens, or encumbrances burden the property, and certify that the parcel is completely free from agrarian or ejido claims.
Yes, completely legally. Under Article 27 of the Mexican Constitution, foreigners acquiring property within the 'Restricted Zone' (within 50 kilometers of the coast or 100 kilometers of international borders) do so via a 50-year renewable bank trust called a Fideicomiso. A Mexican trustee bank holds bare title, while you hold 100% beneficial ownership with absolute rights to sell, remodel, lease, build on, or bequeath the property to your heirs.
Yes, real estate transactions in Mexico are subject to Mexican Income Tax (ISR - Impuesto Sobre la Renta) on the capital gain. Depending on the purchase documentation and resident tax status, the tax is calculated either as 25% of the gross sale price or up to 35% of the net calculated gain after allowable statutory deductions. Foreigners who have official Mexican tax residency and sell their primary residence may qualify for full or partial exemptions under specific conditions defined in Mexican fiscal law.
Under general Mexican federal law, there is no mandatory timeline requiring private landowners to construct on their land. However, private master-planned communities, homeowner associations (HOAs), and beachfront fraccionamientos frequently establish private building regulations and covenant timelines (Reglamento de Construcción). Ballote & Associates reviews all HOA master deeds and municipal permits prior to closing so you are never surprised by unexpected building deadlines.
Ejido lands are communal agricultural lands governed by Mexico's Agrarian Law (Ley Agraria). Crucially, ejido lands do NOT possess private deeds (escrituras públicas) and cannot legally be conveyed or sold to private buyers—Mexican or foreign—unless they have completed the formal, multi-step privatization process known as 'Dominio Pleno'. Attempting to buy untitled ejido land poses an extreme risk of total loss. Our firm conducts rigorous agrarian due diligence to verify legitimate private title before any transaction proceeds.
